When you book a travel project or holiday with us, you enter into a contract with Asia Adventures Co. Ltd., Phnom Penh, Cambodia (hereinafter referred to as ‘Asia Adventures’). These terms and conditions form the basis of your contract. You should read these terms and conditions carefully, particularly as during this trip you may be exposing yourself to an element of personal risk and a number of these conditions restrict or exclude Asia Adventures’ liability for such risks. If you consider any of these terms unreasonable, please do not hesitate to contact Asia Adventures to discuss them.
When requested, Asia Adventures will quote for the requested services. Quotations are subject to change until the booking is confirmed.
Bookings are made to Asia Adventures’ Reservation Dept. in writing by email: info {at} asia-adventures.com. At the time of booking confirmation, you mustl provide Asia Adventures with the full name of all travelers as displayed in their passports, their nationalities, date of birth, passport details, special dietary needs, and any pre-existing medical conditions which may affect the client while on the tour.
2.1 Nature of Holiday & Risks
(i) Your booking is accepted on the understanding that you recognize and accept the risks and hazards that are inherent in the travel of this nature, such as injury, disease, loss or damage to property, inconvenience, and that there is a requirement for a degree of flexibility. The details given in your itinerary must, therefore, be taken as an indication of what should be accomplished on the holiday and not as a contractual obligation on the part of Asia Adventures. Changes to the itinerary en-route may be caused by local political factors, flight cancellations, weather conditions, mechanical failure, border restrictions, sickness or any other unforeseeable circumstances. It is a fundamental condition accepted by sending the Booking Form that you accept a degree of flexibility to the itinerary and acknowledge that delays and alteration and their results, such as inconvenience, discomfort or disappointment are possible.
(ii) Awareness and understanding of local laws, customs, social and religious sensitivities, and relevant etiquette can significantly help to diffuse the potential misunderstandings which give rise to some of the issues highlighted in 2(i). Asia Adventures strongly advises you to prepare yourself thoroughly through background reading and any other means before your travel project or holiday commences, and we will offer any assistance in advising you of suitable reference material. We believe this will improve your ability to deal with any problems that you may encounter and will significantly enhance the enjoyment of your visit.
2.2. Passport, Visas & Health
(i) General advice concerning passport, visa, and health requirements is available on Asia Adventures’ website under General Information and will be sent to you in your ‘Travel Pack’ after confirming your booking. However, such requirements are subject to change and you must check current requirements before departure. It is your responsibility to obtain all documents required for your holiday, to ensure that these are in proper order, and to take them with you. Asia Adventures will not be liable if you fail to do so and you will be responsible for meeting any additional cost incurred by reason of such failure. If you choose to obtain a visa ‘on arrival’ for those countries that allow this process, Asia Adventures is not liable in any respect if, for whatever reason, you are refused a visa and cannot enter the country and continue your travel plans.
(ii) All international flights must be reconfirmed by you by telephone in person to the airline on which you are booked, or through a participating agent of that airline, at least 72 hours prior to departure. Asia Adventures will not be liable for your failure to do so.
(iii) Clients must make known to Asia Adventures any medical ailments or physical weaknesses that may jeopardize your own safety or that of other members of your party, including your guides and leaders, especially where a physical adventure activity is involved.
(iv) Before traveling, you must check with your doctor which inoculations, malaria prophylactics, or other medical precautions you should take for a visit to the country in which your holiday will take place, and it is your responsibility to follow that advice.
During peak periods such as Christmas, Easter, and other local & international public holidays, supplements may need to be added to the cost of the requested services. The supplements may be for certain itinerary departure dates and/or accommodation on specific dates. The cost of these supplements will be quoted to the Agent at the time of booking.
You must pay Asia Adventures in full 30 days before the itinerary commences. Under circumstances where a deposit is required upon booking confirmation, you will be informed. If Asia Adventures does not receive full payment in accordance with this paragraph, it reserves the right to cancel the booking and cancellation charges will apply. No payment reminders will be sent. If a confirmed booking is made within 30 days of when the itinerary commences, you must pay in full upon booking. Payment methods are described below.
4.1 Payment Methods:
4.1.1 Bank Wire Transfer
Bank detail will be advised once the booking is confirmed.
All payments to Asia Adventures must be settled in US Dollars and you must inform Asia Adventures by email: info {at} asia-adventures.com as soon as the remittance has been made. Asia Adventures does not take responsibility for any bank charges or transfer fees that result from the transfer of money. The customer is responsible for any such charges and should not deduct such charges from any payment due to Asia Adventures. Further, US$30.00 will be added to the quotation to cover bank fees that are charged to Asia Adventures.
4.1.2 PayPal
If you prefer to use PayPal, please indicate your preference at the time of booking. A PayPal invoice will be sent to your e-mail with payment instructions. A 3% charge will be added to the quotation for US customers, and 4% for all other countries to cover the PayPal merchant charges.
4.1.3 Alternative Transfer Methods
Alternative methods of cash transfers such as Western Union are also accepted and should be marked for the same beneficiary and followed up with the same notifications as in section 4.1.1. Any other pick-up method must be agreed upon in advance.
4.1.4 Pay by Credit Card, A 3.5% surcharge will be added to the quotation. Once you confirm the booking, our team will send you the payment link.
4.1.4 Local Payments
There may be occasions where payment arrangements can be made by paying Asia Adventures directly at one of its offices. If you wish to use this arrangement it must be agreed with Asia Adventures beforehand by email: info {at} asia-adventures.com.
If the client wants to make any significant changes to the confirmed booking, Asia Adventures will do all possible to assist and provide the necessary services, however, changes in the rate may result. A significant change includes; a pre-departure change of destination area, change of accommodation, flight time change by more than 12 hours, etc. Please note: Scheduled airlines normally regard name changes as a cancellation and re-booking, thus any alteration may incur a 100% cancellation charge.
All cancellations must be advised in writing by email: info {at} asia-adventures.com. The cancellation will take effect from the day the written confirmation is received. Asia Adventures’ standard cancellation fee schedule is as follows:
• < 7 days 100% of the tour price
• 7 – 30 days prior to departure: 50 % of the tour price
• >30 days prior to departure: 10% of the tour price, or deposit paid, whichever is lower.
Please note: Any money transfer costs are non-refundable.
The above cancellation schedule is subject to change based on circumstances such as season or vendor used (hotel, cruise line, etc). Clients will be advised at the time of booking of any variation. Additional cancellation charges may be incurred under certain circumstances, such as reduction of group size, and will be itemized on booking quotations.
6.1 Travel Insurance
Asia Adventures recommends that you have adequate travel insurance before joining the booked itinerary. By sending the email Booking Form you acknowledge that Asia Adventures has advised you and your travel partners that adequate travel insurance is recommended for the duration of your trip. The insurance should include adequate cover for personal accidents, medical expenses, injury, death, and emergency repatriation. Insurance should also provide cover for cancellation or curtailment of your holiday as well as interruptions, delays, and lost/stolen/damaged personal property. You should also ensure that there are no exclusion clauses limiting protection for any dangerous or unusual activities that you might be involved with. Your insurance policy document is as important as your passport and should be carried with you throughout your holiday. If you commence your itinerary without adequate insurance you may be disallowed from continuing without the right of refund. You are solely responsible for arranging your own insurance and you should ensure that you are covered for the full duration of your itinerary. All baggage and personal effects are at all times at your own risk. We will not be responsible for any loss, damage, or accident to any luggage and property, howsoever incurred.
If any clients decide to curtail their itinerary and return home early, Asia Adventures will not offer any refund for the remainder of the client’s holiday not completed or cover any associated costs the clients may incur. Asia Adventures recommends clients have travel insurance that covers trip interruption/curtailment.
Asia Adventures takes great care to ensure that the information and prices quoted are accurate at the time of the issue. However, due to the rapidly changing social, political and physical environments prevalent in all developing countries and particularly in South East Asia, Asia Adventures reserves the right to make changes to itineraries both before and after the booking is confirmed.
Changes are treated as either ‘significant’ or ‘minor’. A significant change includes changes such as; a pre-departure change of your destination area, accommodation to that of a lower category and/or price, flight time change by more than 12 hours. A minor change is any other change. Asia Adventures reserves the right to make minor changes at any time should the need arise and will do all possible, but are not obliged, to advise the client before departure or to pay the clients any compensation. In the case of a significant change being made before the clients’ itinerary start date Asia Adventures will provide three alternatives:
a) Alternative arrangements of equivalent or of very closely similar standard and price, if available
b) Alternative arrangements of a lower standard together with a refund of the difference in price (less any money transfer costs)
c) Cancel the client’s arrangements with a full refund of all payments made to Asia Adventures (less any money transfer costs).
In certain circumstances the cost of agreed services may be subject to a surcharge, including increases in transportation costs (such as fuel and airfares); dues; taxes; fees chargeable for services (including landing taxes and embarkation or disembarkation fees of ports and airports); government action; adverse currency exchange rate variations, etc. Asia Adventures will inform the client of any such surcharges when it becomes aware of them and will issue a revised invoice.
Where such a surcharge would increase the total cost of agreed services by an amount greater than 20% the client reserves the right to cancel the booking with 14 days of the date of issue of the revised invoice, and Asia Adventures will provide a full refund of all relevant payments the client has made.
Asia Adventures reserves the right to cancel the client’s confirmed booking for any reason. However, Asia Adventures will not cancel a confirmed booking within 30 days of the itinerary start date unless a ‘force Majeure situation arises (such as those described in clause 11). If Asia Adventures has to cancel a confirmed booking, it will offer the client three alternatives:
a) Alternative arrangements of equivalent or of very closely similar standard and price, if available
b) Alternative arrangements of a lower standard together with a refund of the difference in price (less any money transfer costs)
c) A full refund of all payments made to Asia Adventures (less any money transfer costs).
Very rarely Asia Adventures may be forced to curtail an itinerary after it has started where a ‘force majeure’ situation arises (such as those described in clause 11). In this situation Asia Adventures regrets that it cannot make any refunds, pay any compensation, or be responsible for any resulting cost or expenses incurred by the Agent or Agent’s clients. But we will do all possible to assist clients.
Asia Adventures regrets that it cannot accept liability or pay any compensation where the performance of its contractual obligations is prevented or affected by reasons or circumstances amounting to ‘force majeure’, which is an event that Asia Adventures or its suppliers could not, even with all due care, avoid such as; war or threat of war, civil strife, government intervention, natural or nuclear disaster, industrial dispute, epidemics, terrorist activity, adverse weather conditions, fire and similar events.
Most problems can be solved immediately if Asia Adventures is informed. In the event of any problems, clients must advise an Asia Adventures representative (or their guide) immediately, as well as the relevant service supplier (e.g. hotel, restaurant, transport provider, etc.). If there is no representative (or guide) and the problem is a serious one that cannot be resolved to the client’s satisfaction, the client must contact the Asia Adventures Head Office +855 (0)78400 233. If complaints are not raised immediately, this may affect Asia Adventures’ ability to investigate and resolve the issue. Please inform Asia Adventures in writing within 30 days of the itinerary end date (booking reference must be included). Asia Adventures will reply within 21 days of the receipt of the complaint letter. Asia Adventures regrets it cannot accept any liability in relation to any complaint or problem if it is not notified in strict accordance with this clause.
13.1 Clients must recognize and accept any risks and hazards that are inherent in travel to a South East Asia country, such as illness, injury, disease, loss or damage to property, inconvenience, and that there is a requirement to accept a certain degree of flexibility. Thus the confirmed booking itineraries must be taken as an indication of what should be accomplished on the holiday and not as a contractual obligation on the part of Asia Adventures. Changes to the itinerary en-route may be caused by local political factors, flight cancellations, weather conditions, mechanical failure, border restrictions, sickness, or any other unforeseeable circumstances. Agent’s client accepts a degree of flexibility to the itinerary and acknowledges that delays and alteration and their results, such as inconvenience, discomfort or disappointment are possible.
13.2 Clients must acknowledge and assume all responsibility for the additional risks and hazards involved in adventure travel activities such as cycling and trekking.
13.3 Awareness and understanding of local laws, customs, social and religious sensitivities, and relevant etiquette can significantly help to diffuse the potential misunderstandings which give rise to some of the situations highlighted in 13.1 above. Asia Adventures strongly advises clients to prepare thoroughly by background reading and any other means before the client’s itinerary commences. Asia Adventures will offer assistance in advising suitable reference material. Asia Adventures believes this will improve the client’s ability to deal with any problems that they may encounter and will significantly enhance their enjoyment of their visit.
If in the opinion of Asia Adventures, any accommodation manager, any transport provider, tour leader/guide or other people in authority, any clients are behaving in such a way as to cause danger, distress or annoyance to others; cause damage to property; or commit any illegal act, Asia Adventures reserves the right to terminate the client’s itinerary. In this situation Asia Adventures has no liability to the clients and will not be responsible for making any refunds, paying any compensation or meeting any cost or expenses that are incurred as a result. Further, the client must meet any expenses Asia Adventures incurs as a result of their behavior.
